License Agreement
This document, titled End User License Agreement (EULA), is a legal agreement between Steffen Flemming (referred to as “Audiodyne”) and you. Please read and understand the terms outlined below.
All rights not expressly granted to the user are reserved. The sound samples included in this sample pack are licensed to you, not sold, solely for use in your original musical compositions. Any copying, lending, duplicating, re-selling or trading of this product or its content is strictly prohibited.
Only the original purchaser of this product has the right to use the enclosed sound samples within their musical compositions. The licensee may incorporate the sounds in combination with other sounds in music productions, including soundtracks for films, video productions, radio/TV programs or commercials, computer games, and multimedia presentations, as well as public performances and other reasonable musical purposes within musical compositions.
It is forbidden to:
(1) Rent, lease, lend, trade, license, transfer, duplicate, distribute, assign, sell, or make copies of the sounds, whether modified or in their original form;
(1.1) Publish, make available, or allow others to copy the sounds;
(1.2) Sell or incorporate the sounds, whether alone or in combination with other sounds, as part of any competitive product such as a sample pack, virtual instrument, expansion pack, or any other collection of sounds, samples, or loop elements in any format;
(1.3) Use the sounds in isolation;
(1.4) Upload, download, or electronically transfer the sounds to or from any server, including but not limited to sendspace.com, rapidshare.com, or similar services; and
(1.5) File share or make the sounds available via online-medium, including but not limited to any peer-to-peer file sharing service such as BitTorrent or any related service.
The use of these sounds in multimedia projects is limited to use within original musical compositions. Any other multimedia use of these sounds must be cleared with the producer of this product prior to release.
This license is granted for a single user only, on a worldwide basis. The license is nonexclusive and is granted for the full period of copyright protection and sound samples. You cannot electronically transfer the sound samples or place them in a time-sharing or service bureau operation or a computer/sampler network. By opening or using this product, you accept and agree to these terms.
Limitation of Liability:
You can recover from Audiodyne and its suppliers only direct damages up to the amount you paid for the sample pack. You cannot recover any other damages, including consequential, lost profits, special, indirect or incidental damages. This limitation applies to anything related to the sounds or content on Audiodyne or third-party internet sites, and claims for breach of contract, breach of warranty, guarantee or condition, strict liability, negligence, or other tort to the extent permitted by applicable law. It also applies even if repair, replacement, or a refund for the sounds does not fully compensate you for any losses or if Audiodyne knew or should have known about the possibility of the damages.
No Warranties:
Audiodyne gives no express warranties, guarantees or conditions. Where allowed by law, Audiodyne excludes implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
